This website is operated by House of Talia. Throughout these Terms of Service, the terms “House of Talia,” “we,” “us,” and “our” refer to House of Talia.

House of Talia offers this website, including all information, products, features, content, and services available through houseoftalia.com (collectively, the “Website”), to you conditioned upon your acceptance of these Terms of Service.

By visiting the Website, creating an account, placing an order, submitting information, or otherwise using the Website, you agree to be bound by these Terms of Service and all policies referenced or linked within them, including our Privacy Policy, Shipping & Delivery Policy, and Return or Refund Policy.

Please read these Terms carefully before using the Website. If you do not agree to these Terms, you may not access the Website or purchase products from House of Talia.

1. Eligibility and Adult Purchasers

The Website and its purchasing features are intended for use by adults.

By using the Website or placing an order, you represent that you are at least the age of majority in your state, province, or country of residence and have the legal capacity to enter into a binding agreement.

If you are under the age of majority, you may use the Website only with the involvement and permission of a parent or legal guardian.

Although our products are designed for children, the Website is intended to market and sell those products to parents, guardians, gift purchasers, educators, and other adults.

2. Online Store Terms

You may not use our products, Website, or services for any unlawful, fraudulent, unauthorized, or abusive purpose.

You agree not to violate any applicable law or regulation when using the Website, including intellectual-property, consumer-protection, privacy, and product-resale laws.

You may not transmit viruses, malicious code, automated scripts, scraping tools, or other technology intended to damage, interfere with, copy, monitor, or gain unauthorized access to the Website or another user’s information.

A violation of these Terms may result in the immediate suspension or termination of your access to the Website and cancellation of pending orders where legally permitted.

3. Children’s Products and Product Safety

House of Talia sells toys and play products intended for children. Products must be used only in accordance with the age recommendations, safety warnings, care instructions, and intended uses displayed on the product page, product packaging, tags, labels, or accompanying materials.

Some House of Talia products may contain small parts and may not be appropriate for children under 3 years of age or for children who continue to place nonfood objects in their mouths.

Parents, guardians, caregivers, teachers, and other supervising adults are responsible for:

  • Selecting age-appropriate products
  • Reviewing all product warnings and instructions before use
  • Providing appropriate adult supervision
  • Keeping small pieces away from younger children
  • Removing and safely disposing of packaging materials
  • Regularly inspecting products for damage, loose pieces, cracks, splinters, breakage, or unusual wear
  • Discontinuing use immediately if a product becomes damaged or unsafe
  • Ensuring products are used only for their intended purpose

House of Talia’s pretend-play food products are toys. They are not actual food, cooking equipment, serving equipment, or eating utensils and should not be placed in a child’s mouth unless the applicable product instructions expressly state otherwise.

Product-specific safety warnings, age grading, and instructions displayed on the product or its packaging are incorporated into these Terms. If general information on the Website conflicts with a product-specific safety warning, the more restrictive product-specific warning should be followed.

Nothing in these Terms replaces the responsibility of an adult to supervise a child and assess whether a particular product is appropriate for that child’s age, development, abilities, and behavior.

4. Product Information

We make reasonable efforts to display product descriptions, measurements, materials, colors, photographs, videos, age recommendations, availability, and prices accurately.

However, the appearance of colors and product details may vary based on screen settings, lighting, photography, manufacturing processes, and natural variations in materials.

Because some products may be made from wood or other natural materials, minor variations in grain, texture, color, finish, size, shape, or appearance may occur. These natural variations are not necessarily defects.

Product photographs may contain decorative items, background materials, props, or accessories that are not included with the product. The product description and “What’s Included” information control what is included in an order.

We reserve the right to:

  • Correct product descriptions or pricing errors
  • Modify product designs, materials, packaging, or specifications
  • Discontinue products
  • Limit available quantities
  • Restrict sales by person, household, geographic region, or jurisdiction
  • Refuse or cancel orders as permitted by law

Product availability is not guaranteed until an order has been accepted and processed.

5. Orders and Order Acceptance

Submitting an order does not automatically mean that House of Talia has accepted the order.

After an order is submitted, we may verify payment, billing information, shipping information, inventory availability, fraud indicators, or other order details before accepting and fulfilling it.

We reserve the right to refuse, limit, hold, or cancel an order where we reasonably believe:

  • The product is unavailable
  • The order contains incorrect information
  • A pricing or listing error occurred
  • Payment cannot be authorized
  • The order appears fraudulent or unauthorized
  • The order is intended for unauthorized resale
  • The order violates these Terms or another House of Talia policy

If we cancel an order after payment has been successfully collected, we will issue a refund to the original payment method, subject to processing times controlled by the payment provider or financial institution.

We may limit or cancel quantities purchased per person, household, account, payment method, billing address, shipping address, or order.

6. Customer Information

You agree to provide current, complete, and accurate billing, shipping, payment, and contact information for every order.

You are responsible for reviewing your order information before submitting an order, including:

  • Product selection
  • Quantity
  • Shipping address
  • Billing address
  • Email address
  • Telephone number
  • Shipping method

You agree to promptly update your account and contact information when necessary.

House of Talia is not responsible for delays, failed delivery, returned packages, or other problems caused by inaccurate or incomplete information supplied by the customer.

7. Prices, Payments and Taxes

Unless otherwise stated, prices displayed on the Website are in United States dollars.

Prices may change at any time without notice. Price changes will not ordinarily affect orders that have already been accepted, except where a clear pricing error has occurred.

Applicable shipping costs, sales taxes, duties, and other charges will be displayed during checkout when available.

You authorize House of Talia and its payment processors to charge your selected payment method for the total amount shown during checkout.

You represent that:

  • You are authorized to use the payment method provided
  • The information provided is accurate
  • Sufficient funds or credit are available
  • Payment of the order will not violate any agreement with a financial institution or payment provider

House of Talia does not directly store complete payment-card information. Payments may be processed by Shopify, financial institutions, digital-wallet providers, or other third-party payment processors under their respective terms and privacy practices.

8. Promotions and Discount Codes

Promotions, sales, giveaways, and discount codes may be subject to additional terms.

Unless expressly stated otherwise:

  • Discount codes cannot be combined
  • Discounts have no cash value
  • Discounts cannot be applied retroactively
  • Discounts cannot be transferred or resold
  • Discounts may exclude certain products, taxes, or shipping charges
  • Discounts may expire or be discontinued
  • Only one discount may be used per order

House of Talia may cancel or refuse a promotion where fraud, misuse, technical error, or a violation of promotional terms is reasonably suspected.

9. Shipping and Delivery

Orders typically ship within 3 business days, unless a different processing period is stated on the product page or communicated to the customer.

All shipping, tracking, carrier-delay, missing-package, delivered-but-not-received, stolen-package, and shipping-damage matters are governed by our separate Shipping & Delivery Policy, which is incorporated into these Terms.

Customers are responsible for providing a complete and accurate delivery address and monitoring tracking information after shipment.

Delivery dates are estimates and are not guaranteed.

Optional third-party package protection, including Route Package Protection when offered, is subject to the third party’s separate terms, eligibility requirements, exclusions, and claim procedures.

10. Returns, Refunds and Exchanges

Returns, exchanges, refunds, damaged-item requests, and order-cancellation requests are governed by House of Talia’s Return or Refund Policy in effect when the order was placed.

Customers are responsible for reviewing the applicable policy before purchasing.

Unless required by law, House of Talia is not obligated to accept a return or issue a refund outside the eligibility period or conditions stated in the applicable policy.

Shipping damage must be reported within 48 hours of delivery in accordance with our Shipping & Delivery Policy.

Refund processing times may vary depending on the payment provider and financial institution. House of Talia does not control how quickly a bank or card issuer posts an approved refund.

Nothing in these Terms limits any consumer right that cannot legally be waived or restricted.

11. Accounts and Account Security

Certain Website features may allow customers to create an account.

You are responsible for:

  • Maintaining the confidentiality of your login credentials
  • Restricting access to your account and devices
  • Keeping account information accurate
  • Notifying us promptly of suspected unauthorized access
  • All activity occurring through your account, except to the extent caused by House of Talia

The Website’s cultural and educational content is provided for general play, representation, storytelling, and informational purposes. It is not intended to serve as a comprehensive or authoritative account of every regional, national, ethnic, religious, linguistic, family, or cultural variation.

Cultural traditions and terminology may differ among families, regions, and communities. These differences do not necessarily indicate an error.

You may not use House of Talia’s cultural content, product designs, or branding in a misleading, derogatory, hateful, discriminatory, or unauthorized commercial manner.

14. Reviews, Photographs and Other Customer Content

The Website or our social-media channels may allow customers to submit reviews, testimonials, photographs, videos, comments, suggestions, or other materials (“Customer Content”).

You retain ownership of your original Customer Content. By voluntarily submitting Customer Content to House of Talia, you grant us a nonexclusive, worldwide, royalty-free, transferable, sublicensable license to use, reproduce, edit, adapt, publish, translate, distribute, and display that content for legitimate business purposes, including Website, email, advertising, social-media, and promotional use.

You represent that:

  • You own or have permission to submit the Customer Content
  • The content is accurate and based on your genuine experience
  • The content does not violate another person’s privacy or intellectual-property rights
  • The content does not contain unlawful, threatening, defamatory, obscene, deceptive, discriminatory, or harmful material
  • You have obtained appropriate permission before submitting an image or video containing another person

Do not submit photographs, videos, names, locations, schools, or other identifying information involving a child unless you are the child’s parent or legal guardian and have authority to provide that content.

House of Talia is not required to publish Customer Content and may remove or decline content at its discretion.

We may edit Customer Content for formatting, spelling, length, or clarity, but we will not intentionally alter the substance of a customer’s opinion.

15. Feedback and Suggestions

If you submit product ideas, suggestions, concepts, designs, improvements, or other feedback, you agree that House of Talia may use the feedback without restriction or compensation to you.

You should not submit confidential or proprietary information through an unsolicited suggestion.

This section does not transfer ownership of a patented invention or other right that cannot legally be transferred without a separate written agreement.

The Website may include links to or integrations with third-party services, including payment processors, shipping carriers, package-protection providers, social-media platforms, analytics providers, advertising services, and other ecommerce applications.

Third-party services are governed by their own terms and privacy policies.

House of Talia does not control and is not responsible for:

  • Third-party security or privacy practices
  • Decisions made by shipping carriers, banks, payment processors, or package-protection providers

Accessing or using a third-party service is at your discretion and may create a separate agreement between you and that third party.

If an order is canceled because of an error after payment has been collected, the amount collected for the canceled item or order will be refunded to the original payment method.

Any product warranty expressly provided in writing by House of Talia or a manufacturer will be governed by its stated terms.

Nothing in these Terms excludes or limits warranties, consumer rights, or remedies that cannot legally be excluded or limited.

22. Limitation of Liability

To the fullest extent permitted by applicable law, House of Talia and its owners, officers, employees, contractors, affiliates, licensors, and service providers will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from or connected with your use of the Website or purchase of a product.

This may include loss of data, lost profits, loss of business opportunity, or other intangible losses.

To the fullest extent permitted by law, House of Talia’s total liability relating to a product, order, or transaction will not exceed the amount you paid to House of Talia for the product or order giving rise to the claim.

These limitations do not apply to liability that cannot legally be limited, including liability arising from fraud, willful misconduct, or other matters for which limitation is prohibited by law.

Nothing in these Terms is intended to exclude responsibility for a defective product where such responsibility cannot legally be waived.

23. Indemnification

To the fullest extent permitted by law, you agree to indemnify and hold harmless House of Talia and its owners, officers, employees, contractors, affiliates, licensors, and service providers from third-party claims, damages, liabilities, costs, and reasonable legal fees arising from:

  • Your unlawful use of the Website
  • Your violation of these Terms
  • Your violation of another person’s rights
  • Customer Content submitted by you
  • Fraudulent or unauthorized activity conducted through your account

This obligation does not apply to the extent a claim was caused by House of Talia’s own unlawful conduct, negligence, or misconduct where such exclusion is required by law.

24. Termination

These Terms remain effective unless terminated by you or House of Talia.

You may terminate your use of the Website at any time by discontinuing use and, where available, requesting closure of your account.

We may suspend or terminate your access to the Website if we reasonably believe you have violated these Terms, engaged in fraud or abuse, created a security risk, or exposed House of Talia or another person to potential harm.

Termination does not eliminate obligations or liabilities that arose before termination, including payment obligations, intellectual-property restrictions, indemnification obligations, and provisions intended to survive termination.

25. Severability

If any provision of these Terms is found to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by law.

The remaining provisions will remain valid and enforceable.

26. No Waiver

A failure by House of Talia to enforce a provision of these Terms does not waive our right to enforce that provision later.

A waiver is effective only if it is in writing and authorized by House of Talia.

27. Entire Agreement

These Terms, together with the Privacy Policy, Shipping & Delivery Policy, Return or Refund Policy, and other policies posted on the Website, constitute the entire agreement between you and House of Talia regarding your use of the Website and purchases from us.

They replace prior or contemporaneous communications relating to the same subject matter, except for a separate written agreement signed by an authorized representative of House of Talia.

28. Governing Law and Venue

These Terms and any dispute arising from the Website or a purchase from House of Talia will be governed by the laws of the United States and the state in which House of Talia maintains its principal place of business, without regard to conflict-of-law principles.

Subject to any consumer right that requires a different forum, legal proceedings must be brought in the state or federal courts located in the county and state where House of Talia maintains its principal place of business.

Before filing a legal claim, you agree to contact hello@houseoftalia.com and provide a reasonable opportunity for the parties to attempt to resolve the matter informally.

29. Changes to These Terms

We may update these Terms from time to time to reflect changes to our Website, products, services, policies, technology, or legal obligations.

The updated version will be posted on the Website with a revised “Last updated” date.

Changes will apply prospectively unless applicable law requires otherwise. The Terms in effect when an order was placed will generally govern that order.
